Employment Ratio and Minimum Salary Have Now Become Part of the Criteria for Visa and Work Permit under BOI – Effective October 1, 2025

The Thailand Board of Investment (BOI) has issued new criteria under Announcement No. Por.8/2568, dated June 5, 2025, regarding the approval, employment, and extension of foreign experts in BOI-promoted projects.

This regulation replaces the previous Announcement No. Por.3/2567 and is legally binding for all BOI-promoted companies.

Effective Date:

  • For new BOI projects (certificates issued on or after June 5, 2025): Regulation effective October 1, 2025
  • For existing BOI projects (certificates issued before June 5, 2025): Regulation effective January 1, 2026

Key legal Requirements:

1. Employment Ratio Rules

  • For manufacturing companies where the total employment exceeds 100 employees, the number of Thai employees must be at least 70% of the total employment.
  • Exemption – No employment ratio required for:
    • Companies with less than 100 employees
    • Service sectors
    • Positions approved for not exceeding 6 months stay in Thailand
  • Manufacturing projects of significant importance and have justified reasons for employing Thai employees below the ratio as approved by the BOI on a case-by-case basis.

2. Minimum Salary and Qualification Requirements

  • Executives Level: Chairman, President, CEO, CFO, COO, CTO, Vice Chairman, Vice President, Executive Director, Managing Director, General Manager, etc.
    • Minimum age of 27
    • At least 5 years of experience
    • Minimum salary 150,000 THB
    • Exemption – the positions of Chairman, President, CEO, and Managing Director are exempt from the age and work experience requirements.
  • Management Level: Manager or Assistant to the executive-level position
    • Minimum age of 27
    • At least 5 years of direct experience
    • Minimum salary THB 75,000
    • If holding a bachelor’s degree or higher – minimum salary THB 50,000
  • Operation Level:
    • Minimum age of 22
    • Educational background directly related to the field of work
    • At least 2 years of direct experience
    • In case the educational background is not directly related to the field of work, at least 5 years’ direct experience is required.
    • Minimum salary THB 50,000
  • Researcher in Science and Technology:
    • Minimum age of 22
    • Educational background directly related to the field of work
    • At least 2 years of direct experience
    • In case the educational background is not directly related to the field of work, at least 5 years’ direct experience is required.
    • Minimum salary THB 50,000
    • If holding a bachelor’s degree in non-related field – minimum salary must be THB 75,000.
  • Other positions:
    • Engineer, IT Specialist – minimum salary 50,000 and 75,000
    • Workstation-Based Operator for IBPO – minimum salary 35,000
    • Teacher, Pilot – no minimum salary but must present a valid professional license.
  • Positions authorized for a stay not exceeding six months shall be exempt from the minimum salary requirement.

3. Approval Periods (Maximum Duration)

  • Positions will be approved for a maximum of two years at a time unless otherwise specified below:
    • TISO / BPO / IBPO: Up to 1 year
    • R&D, IHQ, IBC, ITC, Targeted Technology Development, Electronic Design: Up to 4 years
    • Researchers in Science & Technology: Up to 4 years

4. Extension Conditions

  • Based on business expansion, process improvements, and workforce ratio.
  • Income must be verified via P.N.D.1 or P.N.D.1 Kor tax forms along with the employment agreement.
  • Extension is allowed based on the approved business type.

5. Mandatory Transition After Full Operation

  • After full operational approval, the company is required to reduce the number of foreign nationals in operational-level roles to a level considered appropriate by the BOI.

What You Need to Do:

Review your current and planned foreign experts’ applications to ensure compliance with the new regulation. We strongly advise preparing supporting documents and adjusting workforce structures accordingly before the effective dates.
