On 16 May 2016, the Thai Supreme Court determined that a company with multiple BOI projects must offset tax losses incurred for BOI projects against taxable profits of other BOI projects during the same accounting period before calculating an overall net taxable profit or loss for the combined BOI projects. Only if the result is a net loss may the company then set that loss against the profits of its other projects that fall outside the scope of investment promotion privileges, or carry it forward as a tax credit in future years. The ruling applies even in cases where the profits from a specific BOI project are still subject to a tax-exempt period.
